　　�题一：�银河：中国法律对�性�是比较宽容的　　郑渊�：腾讯网�朋�大家好，我是郑渊�，“郑在阿Q��和大家��了。往常“郑在阿Q�都是我和郑亚旗�这个节目，还从�没有请过嘉宾，我们想第一个嘉宾一定�请中国最��级的，给我们这个节目增加收视率�点击率，今天我就给大家请到了我最尊�的学者�专家�银河。　　�银河：谢谢。　　郑渊�：我有一个�志��《童�大王》，是我一个人写，1985年创刊的，现在写了22年，写到第二�年的时候有一个学校邀请，说他们学校我的读者比较多，能�能让童�大王在那里过20�生日，当时两个学校邀请，一个是北京大学，一个是清�大学，��我在2005年的5月10�，是这个童�大王�长20周年，到北大过了生日。我先是演讲，���银河马上�去美国演讲，我从�没有去过…　　郑亚旗：没去过�达国家。　　郑渊�：对，我�能在北大这个地方。��学生�问的时候，我开始还真�想去北大，给童�大王过生日，因为我�有上过四年�学，没有上过这些大学，我能说玷污了我“一世英明��？（笑）还是有一点怕。��有一个读者�了问题，我马上就觉得没白�。这个�伙�站起�了，他说“郑渊�，�如你的儿�是�性�，等他交朋�回�以�，带的是�性朋�，你怎么看？�我说我尊�他的选择，我比较喜欢美国斯蒂芬金的作�，我说他的女儿就是一个�性�，结婚的是跟斯蒂芬金��的人结婚的，虽然他�愿�，但还是挽�她的胳膊走过了红地毯。我虽然有一点传统的东西，也希望传宗接代，我说能�能留一个试管婴儿或者是采用别的方�。　　 　　在一个法制国家，凡是法律��止的都�以�。 （摄影/��）　　郑亚旗：采用别的方�，�生一个孩�？（笑）　　郑渊�：我马上说，你是�是�到了这样的问题？他说对。说现在没有办法把他带到我的爸爸�父�那儿去，怕他们�愿�。我说他在�在现场，���以让我看一眼，如果我认为优秀，我�说�你爸爸去。他说他是山西人，我说我父亲也是山西人，结果那个男孩一下�就站起�了，确实�常优秀。我说是�都会��，相信你爸爸也会��。然�全场鼓掌。说实在的，我说�北大给童�大王过生日，我并�是特别愿�，但现在我必须说四个字“北大万��，因为那是北大的学生，当时有这样一个情结。最近我看到有一个传播，也看到您的�客上有一个帖�，有一�演员说了这样一��，�说也�是�下说的，�下说咱们也�管。好�是对摄�机，对媒体说的，说“�性�是犯罪�。您觉得是�？如果他说了这个的�的�。　　�银河：我觉得这个�实在是�常�常的过时，让我想起了5�60年�的希特勒，希特勒当时把�性�关在集中�里。有人专门�了这个调查，当时希特勒关犹太人��性�人�共产党什么的，而且�性�在希特勒集中�里�待�最差，干活最�，�折磨最厉害。　　郑渊�：希特勒好�还有一套�论，说犹太人是劣等人�，为什么把�性��共产党�犹太人列在一个范畴里�呢？认为他们是罪犯，�制他们的自由，奴役他们。　　�银河：�能他也觉得是劣等人�，觉得异性�是一等的，�性�是劣等的，�能有这样的说法。西方基�教�派一直�常激烈�对�性�，好�上�说过“����性��这样的�。有一些�常�守的基�教徒也会这样看。　　郑渊�：我也看过圣�，有这样的��？　　�银河：好�是针对男人说的，说��和男人上床�觉，这样是�对的。　　郑亚旗：�性�都�是基�徒�？　　�银河：��在基�教�佛教也�立了这样的组织，之所以管他们�宗教�派，就是宗教里�的�守派�会特别地�对�性�。　　郑渊�：�管是上�，还是圣�，是一个宗教信仰，�是法律。如果说是犯罪，应该是触犯刑法，还�是触犯民法。咱们国家法律里�有没有这样的规定，比如说刑法第多少�？　　�银河：�常幸�的是中国没有这样的法律，但世界上有八个国家�性�是判死刑的，包括伊朗等一些中东国家，�常�常��。我有一次开�性��利的会，会上他们散�的照片，有两个侩�手，世界上有三�多个国家认为�性�是��法的，八个国家是判死刑的。中国是属于比较好的，没有任何关于�性�的规定。　　郑渊�：这个演员也是那八个国家的？也是中国的�？因为也�是咱们亲耳�的，有没有�能是��过这样的�性，�性也有性骚扰？　　 　　�银河：我觉得这个演员说这个�实在是�常�常的过时。（摄影/��）　　�银河：所以我们很怀疑他的动机。会�会他以�有过什么�历，有一些人会�常��性�，好比说他的�妻或者�夫是一个�性�者，那就伤害他了，比如说他是一个异性�，�如那个人也是异性�跟他结了婚，然�生活也没有，有这样的事。但�知�他为什么。　　郑渊�：我看报�说很激烈，情绪很激动，�能有一些难言之�，也�清楚。我觉得如果真的说了的�，而且是对�媒体说，�是一个负责任的人，应该说�比较严谨，�说也是公众人物，说�更应该严谨。�银河刚�跟咱们说了，中国没有任何法律�止这件事情，世界上有一些国家是�止的，而且这些国家给我的感觉，也�能说是��，�正就是�微地规矩多一些，比如说女士戴��纱什么的。咱们国家在这方�还是比较人性化的，比较进步的。所以作为中国人，我觉得还是很幸�的。我最近看到一些�业的�业执照上都改了��范围，�是说原��定你能干什么，现在有这样一��“法律法规�止的之外都�以干�。��范围现在是这样一��，就是法律法规�止的你�能干，除此以外都�以干。比如说我申请了一个修轮胎的车铺，�时还�以�包�。　　郑亚旗：�行，得有�生检疫。�正�书，�报纸，��的都�行，需�特批。　　郑渊�：�计生用�。　　郑亚旗：那�以。　　郑渊�：我挺�的时候，看到上�写�“补胎�，我说这�地方还能给妇女�胎�？��看原�是补车胎的。�业执照这么严肃的东西，都改�了“法律法规�止之外的都�以��。我们在生活当中是�是也�以�解为这样，法律规定的之外都�以�。　　�银河：这是法制国家和�是法制国家的最大区别，一个法制国家，凡是法律��止的都�以�。如果是一个没有法制的国家，就是没有明文�许的都�能�，所以这是一个区别。　　 　　郑渊�：写童�的是�是99%都是�性�？ （摄影/��）　　�题二：�性�者更容易�为艺术家？　　郑渊�：�起�简�，其实仔细一�磨差别�常大。我还有一个感觉，跟您请教一下。我想我们�事，一般有出�的人都是与众��的，�是和常人一样的，有没有�能�性�群体的人，尤其是艺术方��创造性方�，会比��性�群体高呢？有一年记者采访我，是安徒生诞生多少年的时候，说拿安徒生跟我们比较，我说有一个事�太一样，因为安徒生是�性�，他写了很多童�。还有一个作家也是写童�的，就是王尔德，也是�性�。我说写童�的是�是99%都是�性�？　　郑亚旗：还是写的好的。　　郑渊�：我目�还没有进步到这个程度。我还看过一些资料，列举了很多艺术家。　　郑亚旗：包括在建的。　　郑渊�：这样的人，是�是在艺术方��想象力方��创造性方�和��性�的人会有优势呢？就是在�这些事情的时候。　　�银河：从历��看�人�少，包括达芬奇�米开朗基罗�柴�夫斯基，柴�夫斯基当时是被他们的�伴，判他死刑，就是因为�性�。还有很多很多，简直是数�胜数。但这个东西从社会学的角度�看，还是在人群里��机分布的，比如说特别底层的工人�农民也有，艺术家也有，他们会比较地集中在�些行业，�说时装设计师有一个是一个，世界上�国际上最著�的时装设计师�个都是。是�是说他们有一�特别的艺术眼光，这个咱们就�太知�了。�外，比如说花样滑冰�动员�美容美�业地比较集中。　　郑渊�：化妆师�造型师。　　�银河：对，也许他们在这方�有一�特别的感觉，也说�准，包括在色彩上�风格方�，�能会比异性�者更加……说到这儿有一个特别有��的事，就是崔��，电影学院的咱们国家第一个公开的�性�者，他讲课�常好，讲到了边缘人，有时候会有特别的创造力，因为感���，����样的刺激多，��有一个�学课下找到他，说“催�师，会�会因为我是一个异性�，然�创造力比较弱？�很有��。　　郑渊�：比如�性�的��是天生的，还是�天�了什么刺激影�的呢？我觉得中国�性�会更多，因为习惯是异性�引你，比如说�时候，跟�里女�学说���以，因为我是50年代的，跟男生说��以。到底是先天的多，还是�天的多？　　�银河：这个东西�怕�是感觉上的，一般�说认为在�个文化当中，��有一定的数�的人群，里��性�的比例是差�多的。这里�就有�能，并�会因为�北欧国家特别宽�就一下�多了起�，也�会因为一些国家特别严厉，�判死刑就少，��过是转入地下。至于是先天��天，这个东西到现在并没有定论。就�左撇�，你说是先天还是�天？　　郑渊�：我觉得应该是先天。　　�银河：但这个先天和�天一直有争议。　　郑渊�：两�都有。　　 　　�性�是先天�天，现在并没有定论。就�左撇�，你说是先天还是�天？（摄影/��）　　�银河：对，�能两�因素都有。比如很多人研究脑的结构�激素水平��传基因等等，都有所�现，但也并�能够完全地�常确切地下结论，说完全就是先天的，好�还没有结论。其中最著�的，就是�列为的脑内科专家，他自己本人是�性�者，他男朋�是死于艾滋病，���常痛苦，下决心说研究一下这个。人的下秋脑有一个定�的东西，�说通过脑部解剖�现男�性�者跟一般的异性�者�一样，就是那�地方长的�一样。�是这个东西出�以�，先天论好�站�了，但是别人还会质疑，就是怎么确定，在你解剖尸体的时候那个人就是一个�性��异性�呢，还是有质疑，没有最�定论。　　郑渊�：世界上哪些国家�许�性�正�结婚呢？　　�银河：有五个国家。包括英国�比利时��兰���，还有一个国家。美国�州的法律�一样，麻塞诸塞州�以。�法国有家庭伴侣关系，有一��约婚姻，就是给�性��身定�的，因为西方有教�，圣�规定所谓婚姻就是一男一女，有些人�常执�于这个，我们就弄一个一般的�约婚姻。有很多国家，�美国也有很多州�以注册家庭伴侣关系的，夫妻�方享有异性�夫妻的所有�利，包括继承财产�利等等，但就�是正�的婚姻，�这样的也有一批。　　郑渊�：英国�以。　　�银河：英国是正�批准的。　　郑渊�：会�会在�久的将�，看到英国当选首相“夫人��“先生�是�性的，到咱们这儿访问的时候，说是“第一伴侣�。我觉得这一天迟早会到�，而且我觉得�会晚。我�说在咱们国家的�性�数�是五�万左�。　　�银河：应该是在人�的3—4%。别的国家有全国地方的，�现一般都是3—4%。　　郑渊�：我是写童�的，就瞎想。有那��论，说世界人�特别多了以�，就自然地产生一些战争�疾病，��少人�，��生�平衡。我�知�这个�立��立，�笑��笑，�性�也是一�生�平衡的表现，因为�大部分�性�是�能直接生孩�的，应该说是所有的。　　 　　郑亚旗：关于�性�，现在大部分年轻人都觉得很这正常。（摄影/��）　　郑亚旗：�性�是最好的计划生育。　　�银河：我�了一个�案，就是�性婚姻法案，这是一个�由。中国人�爆炸这么厉害，有这么一批人，人家自愿�生育，干��得让人家跟异性结婚�生育呢。　　郑渊�：对，我最近看人�增长速度还是一个问题，其实也是一�爱国行为，就是用自己的行动，等于�增加人�数�。　　�银河：我想起�了，五个批准�性婚姻的国家，还有一个是加拿大。　　郑渊�：我说怎么那么多人到加拿大移民呢，我有一个朋�在机场碰到他，�常著�的化妆师，他�移民加拿大。我还有一个问题，比如说两个�性�，其中一个���性手术，比如��了，还算�性��？　　�银河：其实这是比较�熟悉领域的人，就会把�性�和异性者看��一�人，其实这�两群人。�性�和异性者是�一样的，他们的区别在哪儿呢？�性�自己的性别认�没有问题，他是的男的，他就是男的，自己觉得是男的，她是女的，就觉得自己是女的，但爱的是�性，就是一个男的爱男的，一个女的爱女的。但�性者�一样，明明生�上是男的，但认为自己是女的，很多��性手术的都是这批人。跟�性��是一群人。　　郑亚旗：等于他�完了手术以�，是男的，然�喜欢的还是男的。　　�银河：但他愿��女的，而且�完了手术以�也是女的。很多�性人都是异性者。　　郑渊�：我有一个朋���米，是著�的化妆师，很多著�的艺人都是他担任造型。他最近准备��性手术，我有一次问他，他作客我们的《郑�胡说》，他说�完了�性以��会�给中国男人。我有一点��气，我说让我们没有希望地活�了，为什么��给中国男人，到底跟加拿大男人�外国男人有什么差别？原�还是�一样。其实观念也是在�断地�化��进，很多年�说起离婚，我记得还��方��领导去批准�沟通，感觉是��得人的事。　　郑亚旗：还盖公章。　　郑渊�：现在�说起离婚，就没有当�什么。现在有一个演员说�性�是犯罪，还会这样地有人在讨论这个事情，�能�过一些年，根本就是很正常的了。　　郑亚旗：现在大部分年轻人都觉得很正常，我身边的朋�，差�多就是这个比例，100：3的比例，也就是3%的比例。　　郑渊�：你身边的朋�也有这个？　　郑亚旗：有，很多都是男的。我认识的五个��个，差�多就是一两个，而进入他们的圈�，差�多都是。　　郑渊�：�性�的性别比例，比如说在咱们中国，是男�性�多，还是女�性�多？给我感觉好�是男�性�多。　　 　　从统计�看，女�性�在人�中所�的比例�微比男�性�少一点。（摄影/��）　　�银河：对，美国最著�的性学家，金西调查，男的里�是4%，女的是3%，女的比男的�微少一点。但也有�能，有的女的明明是�性�，但自己�自觉，没有�现，因为男的更明显，如果�到一个异性，根本就没法��那个事情，�是女的是在性上比较被动，明明�喜欢，也�能就那样��了。一般从统计�看，女�性��微比男�性�少一点，在人�中所�的比例。　　郑渊�：一个男�性�和一个女�性�算�性��？　　�银河：�，现在这个事在中国�常的奇怪，在全世界没有这样的情况，因为咱们中国这�传统里�，结婚的压力太大，有一批为了跟父�交代，所以有一些男�性�找女�性��结婚，结婚以�在家里看一切很正常，我的儿�找女孩结婚了，实际上他们�自有朋�，因为他们互相能够�解对方。　　郑渊�：有点�地下党。我就觉得自己生的晚了，如果我�早�几年，就能跟国民党斗争，当地下党，扮�夫妻去。（笑）有没有这样的，�常看到人大代表的一些�案，有没有人大代表�案说中国应该�许�性�结婚？　　�银河：�我所知没有，全都是我�的，我�过几次，都是我�的，我是作为一个普通公民�的。头一次我给了人大代表，那个人大代表是我的一个朋�，他到会上还真�了，但人大有一个规定，得有30个人�议，��他告诉我，找�到30个人愿��议。　　郑渊�：比例�讲，人大代表�能是几�人，按比例�讲，应该有30个�性�。　　�银河：��很深了，中国是有歧视的，还有人说他们是犯罪，你想当人大代表容易�，他们犯罪能行�，所以一定会��起�。　　郑渊�：有没有一个时间上的估计？就是到哪届人大？　　郑亚旗：等我这�数的人长大了�差�多。　　郑渊�：比如说两个男女�性�结婚了，法律上是真夫妻，实际上没有任何生�上的关系，然��自�有朋�，实际上是挺�背人心的，就是很残酷的一件事情，其实结婚�一定�在一起。　　郑亚旗：�一定有房�，一定��在房�里。　　 　　�银河：腾讯网都是年轻人，而且是有文化的年轻人，认��性�的比例�微比全国水平高一些，这说明网�们的觉悟高一些。（摄影/��）　　�题三：�银河：在中国�性�的父�是�常痛苦的　　郑渊�：那结�结婚无所谓了。（笑）咱们�这个节目，腾讯网�了一个调查，请�银河看一下，看这个跟您的研究接近�接近。请问您是如何看待�性�这一行为的？有几个选项，第一个是正当的个人��，无��议。这个选项的赞�票最多，是25687票；第二个选项是��自然�正常，但��是��德，赞�票是11554；第三认为是一�病�的，��德的行为，赞�票是4337人。　　�银河：我�了一个全国大中城市的抽象调查，这个�度比那个更宽容�正�一点。我们那次完全接��性�大概是2�30%的样�。因为腾讯网都是年轻人，这个很明显，而且是有文化的年轻人，�微比全国水平高一些，就是觉悟高一些。　　郑渊�：第二个题目是这样的，如果�现你的�女是�性�，会怎么办？第一个选项是有点失望，但尽�尊�他们，票数是16378票；第二个选项，�对尊�他们的个人选择，票数是11961票；第三个是感到�度痛心，会想尽一切办法改�他们，是8540票；第四感到伤心难过，难以接�，票数是4204票。我感觉好�是缺了一个选项，就是“�常高兴�，也就是�说这个事以��常高兴，�供�妆。这是我虚构的。您以�有没有类似于这样的比例，就是父��现自己的�女有�性�。　　�银河：我们这次调查没有这个问题，这个问题的回答必须有�女的，倒是也�以�设。从我平常的�象中，在中国�性�的父�是�常痛苦的。我�常会接到那样的电�，一个��志，�现他儿�有�性�，这个�亲�自�，说让我��。我说这个儿�怎么自己交�男朋�，挺高兴的，这个�亲�自�。�能他们是一个特别�的�城市，无颜�对周围的，周围压力比较大。我还接到一个电�，这个�亲�现儿��性�以�，说到底自己�错了什么，我说您没有�错什么。他说是�是因为我跟他父亲离婚什么的，�是能改过�的�，我们为你�婚都行。我觉得她这个就是给自己太大压力了。在中国，好�父��现�女是�性�以�压力太大，应当是�压的。国外�立了很多�性�父�组织，就是他们自己交�，如果�现自己孩��性�以�怎么办，怎么应对周围的压力，怎么�对孩�，我觉得中国缺少这个东西。　　郑渊�：应该是看到曙光了，因为腾讯网的调查�大部分是年轻人，�大多数人还是尊�孩��性�的选择。等现在的孩�，就是80�到4�50�的时候，如果他们的孩��到这个问题，我想就�会有您说的自�的，甚至为了孩�改�自己的性��—�婚。还有最�的一个调查，如果你�现一�好朋�是�性�者，这个�有问题�，是好朋�怎么会刚�现�性�呢？　　郑亚旗：自己�说呗。　　郑渊�：就算是�。如果�现你的一�好朋�是�性�者，你还会和他继续交往�？第一个是当然会，性���影�我们的交情，票数是28934。第二个会继续交往，但交往过程中会有点心�障�，票数是9052。第三会尽�离他远一点，人数大幅度下�了，是3013人。最�一个就是�决和他断交，票数是1130人。　　�银河：我们这次调查正好设计了这个问题，如果熟人中�现是�性�者，愿�愿�和他交往，结果差�多，说明中国人包容度很高。能继续交朋�的，�能过了�数。��我和美国数��香港点击查看香港�更多城市天气预报数�等相比还高过了他们。　　郑渊�：其实我���包容这个�，�包容�呀，人家包容咱们。�性�和�德�质没有任何关系�，其实这一个�字就足以说出�，�明�性�的简直了，就是您说的达芬奇。而且我还考�过，觉得曹雪芹也是�性�，我从《红楼梦》里�看出一些东西�，我觉得没有这些�能写�出�这个。有没有这�考�？　　�银河：还没有�说。　　郑渊�：到时候�请您过�，我们把《红楼梦》里�的一�一�拿出�，因为�是�性�，写�出�，没有那�感�。因为我爱走神，�节目的时候一直算，算我身边�性�的朋�，大概是11个，包括官员�作家�在校大学生，有两个还是�士等等，�正�个门类的人都有。我回忆跟他们交往的时候，没有任何的别扭或者是�适。而且我觉得，我认识的这些人都挺与人为善的。您是�是�以�这样一个调查，在犯罪人群当中有�性�的比例和在现实中的比例有多大差�？比如说有攻击性的人，�社会的人有多少，咱们�说关进去的，因为关进去就��到异性了，没办法。那也有�天�为的因素。　　�银河：有一个�性的环境，如果出现异性对象，马上就�适了，这是�欲性的�性�。　　郑渊�：就是阶段性的。　　�银河：环境造�的，临时的。　　郑亚旗：我觉得�性�我们都能接�，比如说我。但我�能接�，�跟男的好，�跟女的好。　　 　　如果�现自己孩��性�以�怎么办，怎么应对周围的压力，怎么�对孩�，我觉得中国缺少这个东西。（摄影/��）　　�银河：这是�性�，有一批人。我记得我在北大教书的时候，有一个美国�伙�，特别漂亮，他�课。有一次在一个�会上碰到，他有一���象�常深刻，��是完美的人，美好的人，就是应该男的也爱，女的也爱。　　郑亚旗：�是性别的��，是人的��。　　�银河：�正他就是�性�。好�这�演员也骂了�性�，说什么�性���性�都是犯罪，拿�德败�都�能说他们，�能是犯罪。　　郑渊�：�如有人说异性�也是犯罪呢？一个性质�，说�性�是犯罪，异性�也是犯罪�，性质是一样的�。我觉得中国生存环境还是越�越好，大家都很宽容了，��你们�触犯法律，没妨�他人，别人的事别去管。我们�时候看的童�就是这样的，童�里�也把人物划分了，�阶级斗争的模�套过去，比如说�白兔�山羊是好人，大�狼��狸都是�的，还有中间人物，�猴�，好��常犯错误。看这�的，一有文化大�命，马上就点起�了。现在这�环境，这�事没有了。但�能说别人的一个性��就歧视别人，其实你也是一�性��，异性�也是一�性��，�时�性�也是一�性��，这是没有对错之分的。所以说他是犯罪，你也是犯罪。我这里有一��，这是一个越似接近崩溃的时代，没人�制你，�有你自己�制自己，��在�守法律的��下，越肆无忌惮越好。我妈妈从�对的教育是，哪儿人多别去哪儿，我说什么��，说哪儿人多哪儿�安全，���大�，��跟�别人�股走，�走自己的。　　郑亚旗：那你怎么�是�性�？　　郑渊�：那�一样，我有自己的性��，如果我是�性�，还有你�？　　郑亚旗：�是�天会��。　　郑渊�：是�是军队特别多。　　�银河：对，�军队�修�院，都是�欲的。您说的“肆无忌惮�，我觉得“自由�比较好，自由是一个正�的价值。　　郑渊�：我知�差�在哪儿，因为您是学者，所以说�特别严谨。我是写童�的，就肆无忌惮，所以安徒生�王尔德能永垂��，如果你有一个感�的想法，比如说《��柴的�女孩》�《皇�的新装》，比如我们在欣�蒙娜丽莎的微笑的时候，如果有点亮良心的�，请您记�，这�能是跟你性���一样的�性�者为我们创造的这些精神财富。所以�是鄙视�性��歧视�性�，甚至将�性�视为犯法，我觉得应该修正一下自己的�维��，我们今天就到这儿，谢谢�银河作客我们的“郑在阿Q�，欢迎你继续�，然��天去美国。　　�银河：22�。　　郑渊�：好，谢谢。　　（出处：腾讯网�2007年8月15日）
